    Hello,

    In March 2005 I signed a one year lease on an apartment with 2 other people. All three of us had signed the lease. In August of 2005, One of the roommates left without notice, and disappeared.

    I haven't been able to find her until now (December 2009), when I came across her working at a fast food place in my city. Is there any way I am still able to sue her for her portion of rent from August 2005 to March 2006?

    I am not in Canada but have researched this a couple of times. It's my understanding that the Statute changed on January 1, 2004. Debts incurred on or after that date have a TWO YEAR STATUTE; debts PRIOR to that date fall under the old six year Statute.

    Her debt to you is AFTER January 1, 2004; you are bound by the two year Statute.
