    Adding party to real state title in Washington
    My son and I are living in California. My sister lives in WA, she borrowed my money for down-payment to buy a house in WA. She did buy a house last year. Now, she is enable to pay back my money. We want to add my name and my son's to her real estate title until she pays back my money. My son is 13 years old, can we add his name on a title? What do I have to do? What the documentation do I need to fill out? Can we do it in California? If I've had my name on her title, do I have to pay WA property tax?

    You can use a "Quit Claim Deed" to put you and/or your son of any age, on title. This does not mean that they are then also on the mortgage. It has to be filed in the county that the property is in. If you know what you are doing, and if anyone currently on title will willingly sign the Quit Claim Deed, then it is a simple matter. You can use a Title Company in that county for a nominal fee. (look in yellow pages for Title Cos.) There may be a filing fee between $21 and 1.78% of the amount owing on the mortgage depending on the relationship of the individuals involved, (family $21 or non-family 1.78% of amount owing on property.) How will she know that you will remove your names (your interest) when she pays you back? Don't you have a Recorded Deed of Trust and Promissory Note? Do you know for sure that she is current on her payments? If she is not, then you have additional problems.
