    Maximum time in jail for a probation violation
    What is maximum time someone will do in prison for a probation violation. This person completed 2 years of his 3 year probation.

    Hello t:

    If the underlying sentence was 3 years, he can be made to serve the entire 3 years. Probation time on the street doesn't count.

    If you would like a good idea of just what the maximum sentence in jail would be just consult the original sentencing paperwork. It should be spelled out in great detail there. The Judge already has decided what the maximum time in jail/prison would be and did so in the Final Disposition paperwork or Sentencing paperwork where he affixed his signature. Find that paper and you'll get your answer. If you can't find the final dispo sheet, call the Clerk's office and they will read you what the final dispo said over the phone.
