    Salary rights
    The company I work for is going bankrupt. They are prolonging it to avoid the warn act. The company made all employees use all if any vacation/ sick pay. This has been going on now for two weeks and my vacation pay ran three days in. I have not been let go and I am a salary employee. Since I have not been let go I can not collect unemployment or can I, Or is the company obligated to pay me a regular pay check since I have not been fired/ let go??

    Do you have an employment contract or belong to a Union?

    Your employer must pay you for the time you have worked and for vacation/sick time you have used.

    You, of course, cannot collect Unemployment Insurance until you are advised there is no work for you.

    I can't tell if you are actually working right now or not. You say your vacation pay ran out but I can't tell if you are working.

    No I have been told to stay home and wait out the bankruptcy or possible buy out. In the mean time I am falling behind on bills and not making any income. I am not able to collect unemployment. And yes I am in a Salary position, so I guess I have a contract for my salary. Both my employer and I signed an agreed weekly salary, but not in a union.

    That's what I thought. The company was telling the employees they could not collect unemployment because they were not fired they were fer-load. Thank you for all the responses, it has been helpful.

    Yes - technically you ARE laid off. Apply for Unemployment ASAP so at least you'll be getting some kind of money coming in. Your company is just being a jerk. Don't listen to them.
