Just because you are relinguishing your vehicle for unpaid balance, doesn't mean you are off scott free. They want what you signed up to pay, so yes, if they have a judgment against you, they will still come after the rest of the money.
Tick
I can not pay for it now how am I expected to have them garnish my pay and financially be OK, I am going to do a voluntary repo because financially I am struggling so much, I don't want to be put in a position where I am going to be in the same position and not have a vehicle
What should I do I can not afford it anymore, payments, registration, gas, insurance can't do it
You'll be saddled with the remaining balance after the auto is sold at auction. It does not matter if you can't afford it now or later as the finance company has a contract that you signed.
You need to figure out now what sort of transportation you will be able to afford and then buy it even if it's an old car. At least you can get from point A to point B. Or you'll be looking at public transportation and most places that simply does not exist.
There is little differnce between a voluntary repo and one where they have to hunt you down except for the repo man fee.
That is if your bank or lender will even allow a voluntry repo, have you discussed this with them, just because you want to, does not mean they will take it back that way.
You can ask for them to take it back as paid in full but not very likely.
But yes, they will sell it ( expect it to sell for a lot less at auction than it is worth) they will add the legal fees and the auction fees to what you owe.
