This is a question for a friend, honestly it is!

A friend of mine has been excused of abh and theft. He has not been charged yet as its being investigated. Long story short is that it is malicious so the person doing the accusing will withdraw their statement. If they do this will the case be dropped with the police or could they pursue it themselves?

You didn't provide enough information... But, if there's NO evidence beyond the complaining witness, they won't proceed.

They MIGHT charge the one who filed a false police report, though.

It is very much a he said he said situation. Someone has excused my friend of beating them up... no evidence of that other than his word, he also accused him stealing his stuff, again no evidence BUT my friend does have his stuff as he says it was given to him! No proof of anything.

My friend hasn't denied having the stuff but does not admit to stealing it as it was given... he has since sold the goods.

Part of the problem is is that he has previous for such things.

It turns out later the man accusing was just trying to get him in trouble and now will withdraw the statements.

The person wants their stuff back through the police getting it back for them SO...

Can he still get in trouble?

If there are no charges, the cops won't help him get his property back. Even if there ARE charges, cops don't help get back property. They only arrest people and charge them with crimes.

At the moment there are charges as nothing has been withdrawn... the police are getting the stuff back for him as they know where it is. Once he has his stuff he will withdraw the statement.

So if no statement... no charges?? Is that correct?

I doubt that if the authorities get involved in recovering the property he will be allowed to withdraw his statement. At that point SOMEONE is getting charged - if it turns out the statements were false, the one accusing will be the one in trouble.
