    He will be released from jail in March. Can he file bankruptcy if the credit card company hired a lawyer and he is served papers.

    Yes, you can file bankruptcy while you're in prison. You will need to meet with a bankruptcy attorney to discuss it because of the amount of paperwork and court appearance for the 341 creditor meeting. Keep in mind once filed, it takes about 30-45 days later for the meeting of the creditors. If he's being released in March, you might want to wait, unless there are other circumstances involved. Regardless of when you file the case (whether now or later), all judgments and lawsuits are immediately halted. Good luck!
