    I'm now receiving umemployment my question
    Is can they take my
    Income tax refund with me
    Havind an exempt refund.
    Please please help.

    How is your income tax refund exempt?

    To the best of my knowledge IRS (and NY) will not accept a lien against a refund check. However, once that refund is deposited in a bank account is fair game.

    Your Unemployment, of course, cannot be garnished.

    Your unemployment is safe. I'm not sure who it is that petitioned the court to get the judgments against you, i.e. (credit card company, mortgage lender, auto loan, etc.) Unless those judgments have anything to do with back taxes to the IRS (or government loans in some instances), then you're entitled to your refund without hindrance. As the earlier post suggests, if that refund is direct deposited to your bank account, the bank account could get levied and/or frozen if a court order is still in place to do so. If you find that your bank account is frozen at tax time, then do your taxes and elect to have your refund mailed to you instead of direct deposited. If you are going through hardship with job loss and your debts are getting out of control and/or you're receiving threats of legal action by creditors, then you may wish to consult and/or retain a good bankruptcy attorney.
