    Divorce Summons
    I had my soon to be ex- husband served divorce papers. I had to hire a process server in Canada because that is where he went back to. I had the Summons (certified copy) and a Summons (service copy) mailed.

    Who will send me back the Certified Summons? The Process Server or my soon to be ex- husband?

    He's not your soon-to-be ex-husband. He's legally your husband.

    The Affidavit of Service for the Summons and/or Complaint - if that is what you are asking - will be sent to you by the process server. I don't know what you mean by the certified summons.

    Are you represented by counsel? There very often are time frames within which the Affidavit MUST be filed with the Court.

    Just came on here to say Thanks but never mind I found my answer.

    To Judy: He is my "soon to be ex-husband as we will be "soon divorced".

    I mention it only because I've seen Judges jump down the throats of people using that phrase, considering it to be flippant.
