    What documents would a person take to a court commissioner in case of a credit card?
    What if the person has not paid on that said card for over three years?

    Hello s:

    If you're here in the US, you don't take anything to the court commissioner. You visit the clerk of court to file your small claims lawsuit. When it's your day in court, you bring everything that proves your case.

    PS> (edited) I read your question again. Apparently you are being sued for credit card debt. How long it's been makes no difference.. If you have any cash, I'd try to make a settlement. It'll cost you a lot less than a judgment will. And if you owe the money, they'll get a judgment no matter what papers you present.
