Childsupport and father on disability in Pennsylvania
I receive 735.00 dollars in social security diability. I recently had a conference hearring. I was told by the conference hearring judge that the poverty line is 748.00 dollars a month. She told me that there guidelines cannot leave me with less than 748.00 dollars a month. I received mail stating that I have to pay 55.00 dollars a month, that leaves me with 685.00 a month. Is this legal and if not what can I do about it? I also live in a different state than Pennsylvania.

Have you gone down to Social Security and signed your children up for their benefits if you are receiving disability from them?

The kids would probably each receive a check more than $55 a month. Call up SS tomorrow and see what they would be entitied to and then go down to their office and sign them up ASAP.

    Child support and disabled father
I'm updaing my question from before. I receive ssdi in the amount $735.00 a month. I was told at the conference hearring by the judge that the state poverty line for Pennsylvania is $748.00 a month. That I cannot be left with less than the $748.00 a month. There was an order put in for me to pay $55.00 a month in chid support. I have 3 kids, one lives with me, and they all receive $26.40 each from my benefits. I am being left with $685.00 a month. I don't no if this makes a difference or not but I do live in Missouri. When I was first declared disabled the child support case at the time was closed. $55.00 isn't a lot, I know that, but that is one of my bills. And when ssdi is your only income $55.00 is a lot. Is there anything I can do to have this stopped? I can't go get a parttime job cause I'm not allowed to work.

They can not force you to live below the poverty lines. If one child is living with you legally then you need to notify them of that and have things changed. The poverty line for a single person is around 950 per month. The figure you were quoted is wrong. For 2 people ( yourself and 1 dependent ) that figure is higher according to federal guidelines.
