The fact that she is a family member has no bearing on the law. The key here, as Chuck asked, is whether there was an agreement to pay rent. If so, then you can serve her with a pay or quit notice giving her 3-10 days (depending on local law) to pay in full or vacate. If she defies that notice, you then go to court and file for an eviction order. If you can't prove an agreement to pay then she is a resident on a month to month basis. In that case you have to give a 30 day notice to vacate before you can file for an eviction order.

Your local housing court or equivalent can give the local rules.
