His rights after he hit me
Well my current problem is that my ex hit me while I was holding our 3 week old son, he was arrested for it but denies it, I only have a light bruise but basically his word against mine, my 5 year old son seen this happen but police are likely not to let him give evidence... luck is never on my side and I feel he will get away with this and I'm going to find it hard to look at him again. I just don't know how to feel.
I want to know where I stand if he's not prosecuted (for lack of evidence or just found not guilty). Can I request supervised access only for his baby, and where do I stand on moving from the area. I feel this I the last straw now, want a new start elsewhere, too many bad memories round here

Before we can answer we need to understand more about the situation. Are you married to this guy? Is he the legal father of both children? Is there a custody/visitation agreement in place and approved by a court?

We've never been married, never lived together, we split during pregnancy and he isn't my eldest sons father, he is named on the birth certificate

And there is nothing ordered by the court? When you are asked follow-up questions, please answer ALL of them.
