Please Help Me. I Was Caught By The Security Of The Store, For Thye First Time. They Got Back The Jacket I Stole (200 Dollars), And Called The Security Of The Mall, The Guy Banded Me Of Showing Up In The Mall For A Year. Then They Called For A Police, Police Gave Me A Ticket Of 65 Dollars. Because I Am Anxiety Disorder And I Am Under Medication. I Was Bewgging The Guy Before The Police Copme That Do Not Call A Police , Then I Was Trying To Kill Myself With My Medications. He Got It And When Police Came They Told Him That I Was Attemptign Syuicide, Police Arrested Me Took Me To Hospital For Check, And Gave Me Teh Ticket.

Now My Questions Are
1. If I Pay The Fee , Does My Record Will Be Removed
2. I Applied For Security Clearance 1 Month Ago, Do You Think It Shows In My Record, Or Ever It Will Show In My Record, In Order To Get A Job In Canada (government)
3. How Can I Pay The Penalty In The Other Way, And Askthe Security To Let Me Pass The Mall And Instead They Charge Me , Is It Possible At All

Help Me, It Was My First Time, I Was Under Pressure To Get A Gift For My Sister, And I Was Not Abwel To Tell Her Thjat I Do Not Have A Job Now, I Was So Depressed Of My Situation That I Suddently Tried This Stupid Action!

I Really Do Not Want It Shows In My Record, Or They Arrest Me When I Am Passing From The Mall In Front Of My Friends , etc. I Really Rather To Die Than Having A Black Criminal Record. First, DON'T KILL YOURSELF! It makes it tough to help!

Second, your not the first and you won't be the last shoplifter. It's not good but it's not that bad.

Third, tell us the state (or if your very lucky) maybe you live in Canada. If you live in Canada (and I think you do) you can ask for the 'Alternative Measures program' where you avoid court. This is for you because, really, you would fall to pieces in court. Also, this takes minimal or no legal services which means it will cost you little or nothing. See, you feel better already!

How do I know that I have to gio to court or not? No one mentioned it , when I will go back home I will check my ticket again, to see whether I have to go to the court or not

I agree, it sounds like you weren't even arrested. A typical arrest would begin with the police giving you your rights, taking you to the police station and giving you a 'notice to appear'.

The only money that you pay after an arrest is bail.

If you have a question on the ticket take it down to the court house and ask.
You should be able to just pay a fine and that will be the end of it.

But you have a right to an attorney, and they may or may not be able to do more about it.

But my question is whteher it will show in my security clearance record or not, if I am not really arersted, because as you said police just gave me a ticket and did not take me to the police office and he did not give me any notice to appear.

As you said, I was not arrested, becausde the police came to the store, gave me the ticket to me, the only reason he arrested me was because of my suicide attempt, that he took me to hospital and left me there. I ask him whether tit shows in my security clearance record , he said "NO"

Which one is my case?

Under the criminal code of Canada sec.322 theft is a dual procedure offense. Dual procedure means it can be prosecuted as summary conviction or indictable. The summary charge is no longer possible after 6 months, but the indictable charge never expires. We don't have any statute of limitations for indictable offences in Canada.

excon, your suggestion that she needs an attorney will just drive her deeper in debt, she admitted she took the item, why not just pay her dues to society by taking the punishment of whatever, fine, jail time, or both, then instead of wasting money on an atty, she could spend the money on the psychiatrist who may help her with her emotional issues.

Maybe your advice would be more welcome on the politics board, or maybe the personal problems board.

Here, we help people who have been charged with a crime. If you're going to judge people here, as you've obviously judged me, and tell them they belong in jail, your advice isn't going to be too helpful

1. The security clearance will not have shoplifting because you were not arrested. However, the suicidal tendency my be on record since you state that you were taken to the hospital by police. You should be able to find out by contacting the police department (I do not have experience with security clearences).

2. It sounds like the mall security dropped the case. If they said stay out then I would believe if they see you there, they will go through with the original arrest and your clearance will be affected.

How can I clean this second mess?? Yes police several times told me , tehre is nothing related to shoplifting, but becayusse I made him upset and he asked me are you gopign to kill yourself, I said yes, he arrested me... yes he wrote a report on his norebook. Now what can I do for this second mess??

I wouldn't put too much the suicide thing either. It is natural for people to over react during a crisis. You did not receive a 'Promise to Appear' document from the police and didn't have your rights given or be taken into custity (be searched, put into interrogation, and have shoes and anything with a string removed so you don't harm yourself). These are all madatory by Professional Conduct of Officers upon an arrest.

So, in simple, you were not arrested.

Here is the example of the ticket I got . Crime theft in sears, and I had to sign that I am guilty and pay the fine to the Tresure of the city

Natalija I am in the same boat as you. I was caught shoplifting at H&M in Toronto and I had to pay a fine for $75 to the Ontario Legal Services. When I asked the security guard whether it would be on my record, he said only if you work for the government because they do deep screening record checks, but for regular jobs and such, it wouldn't show up. If I knew any better, I would've taken the "diversion" program, this is a program where you do a bit of community service or make a donation to a charitable foundation and have the record erased. Unfortunately I pleaded guilty and now it is in my record. As for H&M, they are charging me with an additional $500 for a "settlement amount" which includes investigation, administrative and other charges. In other words, its bull money they just want from me. If anyone can help me, please do.

Apparently there is precedent (see other similar threads) for retailers to charge a settlement amount as a deterrant to such crimes. So, in Canada, this is legal extortion.

You need an attorney willing to fight this. Otherwise you got to pay.

An attorney can often work out a plea agreement, something they don't normally let the accused person do on their own.

The lawyer goes and says you will pay this and do this, if they will dismiss any criminal charges, the city gets money, the store gets paid back and the charges are dismissed. I did this on a traffic ticket last week.
