Can someone's mother sue me for a bill that's in her daughter's ex husband's name?
I live in the state of Georgia and I am being sued. The defendant is a 31 tear old woman who is competent and can file on her own. Her mother filed for her and signed as the agent. Her mother has no degree and is not a member of a business or coroporation. Is this legal?
She is suing me for storage building rent and the bill is in your daughter's ex-husbands name. The mother took my stuff out of someone else's storage building where I had it stored and locked it in the storage building without my permission that she claims I owe for. Does she have the right to do this and how can I get my stuff back??

If its small claims court its legal. Even in Civil court it may be as long as she doesn't pretend to be an attorney.

You are saying someone removed your belongings from where you had them stored and moved them into another building. How did she get access to the building your stuff was stored in? There has to be more to this story.

It was in a friend's building and I was on the way to get it and she called me and told me while she was there unlocking it and getting my things together the woman took it. I have had several problems with her harassing me. She has even put my picture as her default on her myspace page. I am not a very confrotational person and tend to let things go. The stuff belongs to my 10yr old son and after hearing him cry for his playstation and games for 3 months Ive had enough!

You should have immediately called the police and had her arrested for theft. Why did your friend allow a stranger to take your stuff?

Why aren't you, at least, suing her?

She isn't a stranger. She is the mother of a girl that I use to be friends with. I called the police department and spoke with the chief. He is suppose to get back in touch with me. I don't see how she can take my stuff without permission? She said that she had the right because my friend let her get it out of her storage building and that it is now hers.

I am confused how she can file the claim in her daughter's name and sign as her agent? Her daughter wasn't present when she filed the claim. And how she can sue me for a storage building that is not in either one of their names? It hasn't been paid in over six months and she just stole my stuff that she said she could legally take and put it in there 3 months ago.

She has a point. Since the objects were in your friends possession and your friend let her take them, she can be considered to have had tacit permission. Again I ask why your friend let her take the stuff.

See what the police say, but if they won't go after her for theft, then immediately file a counter suit.

Forget about how she filed. That's not a real issue. The real issue is that she took the stuff without your permission, that's what you need to focus on.

Thanks! I am going to file a police report and see if that helps. I've never been in trouble before and have never had anything like this happen. I am currently unemployed and do not what to do about the whole situation.

This is where you don't call up a officer who is a "friend" you call up the police dispatcher and have the officer on duty come ove and take a report. You want a report filed, and hen you call he DA about the follow though.

In addition, you sue them, (* should have sued first) for the value of the items)
