    Getting out of rental lease
    I have a 70 yr old father that is renting a condo at the moment. He signed a 1 years lease in May of 2009. A little longer then a month ago his Dr determined that the elevation where the condo is is to high for him and it is causing him to have breathing problems along with other medical issues. We got a letter from the Dr. that he would have to move to a lower climate for health reasons. We told the landlord about this and gave him notice to move. The landlord informed us that he would need to speak with the owners. Also my father has Section 8 so we needed to get a mutual agreement to be able to break the lease. The owners refuses to let him out of the lease. My father is having to move and the landlord is taking there sweet time trying to get the condo rented, and of course he would because basically he is getting free rent with the Sec 8. My question is: Can a landlord/owner be forced to terminate a lease when there is a health issue involved and a Dr.'s letter has been written? My father lives on Social Security as his only income and can not afford to pay for 2 apartments. What can we do? Any suggestions would be grealy appreciated! Thanks!

    Health usually has no bearing on a lease. You could walk away from the unit and see if they sue you for the rent. Then it would be in the hands of a judge who might be sympathetic to your dads health issues.

    Try negotiating a buyout. Also talk to the Section 8 people to put a time limit on things.
