I own a home with another person. The mortgage is only 4 years old. I recently moved off the property and there is another person living there other than the co-borrower. I never agreed to this person living there and no lease agreement has been signed. I do not want this person living on my property for failure of the mortgage being paid.


I have a few questions. What are my rights as a homeowner of evicting this person from my home? Can a lease be signed with just one homeowner and not both? What are my options of removing my name from a lease without the coborrower agreeing to it? Can I force the sale?

Since the other owner is an equal partner in the property, they have the right to have someone stay with them.

While the co-owner can't sign a lease without you, they don't need a lease to have someone live there.

You can, however, sue to have the co-owner buy you out or force a sale.
