I'm on felony probation for a fake id, and on misdomener probation for 2 d.u.I's. I violated with a shoplifting charge and have my felony hearing coming up. I know the state is going to want me to do prison time. Is there any advice you can give me to plea to the judge that that's not where I belong? N rehab is what I need?

If the Judge thought you needed rehab for the 2 DUI's, he would have ordered it. More than likely he would have ordered you to attend AA meetings. Shoplifting has nothing to do with drinking. You are just trying to figure a way out of doing any type of jail time. You will have to attend your violation of probation hearing and hopefully try to convince the Judge you need rehab. I'd be surprised if he ordered it though, as you seem not to learn to stop breaking the law. He just might prescribe some county jail time to help "cure" you of your breaking the law habit.

How about you enroll yourself in some counseling and rehab programs before the hearing comes up? If you show that you're doing things on your own volition, without being ordered to do so, that will show that you are at least acknowledging that you need help and are willing to go through the steps it takes to get help.
