    If I am not sure if I am the dad and she wants child support , is there anyway that I can get a free dna test taking I don't have that kind of money right now? I really want it to be mine but if it isn't then I'm gone. My parents have already giving her money for doctors appointments and stuff that she needs but what if the baby isn't mine can I get that money back?

    What you need to do is go to your local job and family services (aka: food stamp office, welfare dept.child support), and either ask them how you can get a free dna test, or just have her apply for a welfare check. If your name is not on the birth certificate they will automaticlly make you take a dna test to prove paternity. If u are the father, u will be ordered to pay child support. If not, the egg will be on her face and I would take her to small claims court to get back the money you have given her. Or you could take the easy way out and call maury! Lol good luck to you.

    The odds of any court awarding that money back are next to nil.

    It's not in the CHILD'S best interest to do so---and most of the time the court cares more about the best interest of the CHILD than of either parent.

    If your parents paid for doctors bills then can't they pay for a DNA test?

    How are you going to pay child support? You said that you hope it's yours but you can't even afford a DNA test. That's the cheapest part of all this.

    I'd like to ask, though--if you can't afford the $400-$2000 (depending on your area) for a DNA paternity test, then think about paying that amount EVERY MONTH in child support for a child that might not be yours.

    As a taxpayer, *I* certainly do not want to pay for YOUR paternity test. YOU were the one that couldn't keep your pants on.

    My personal advice is to decide whether you want to be a parent, THEN figure out what you're going to do. Either you care for the child or you don't---but choose and live with your choice.

    I doubt that you'll be able to get a "free" DNA test anywhere. But one is definitely in order ; scrimp and save as you must. Depending on the laws of your state, you and her may have to share the cost or you may have to pay it all. I do believe that a couple of states may actually do it for free. I'd check with your state's welfare or child support agency. Or maybe even arrange for a free or low-cost initial consultation with a local family law attorney. As for getting back the money your parents forked out for her medical expenses, I don't foresee them getting it back if it turns out that you're not the dad. They'd have to prove, by a preponderance of the evidence, that they gave her that money and she accepted it on the condition that you are the father and that there was a mutual understanding that she'd reimburse them if it turns out that you're not the dad. That's a pretty tall order to fill in a court of law.

    What State are you in that provides free DNA testing if a Court action is pending? In NY, even Welfare requires payment.

    As far as being ordered to pay back support - again, what State are you in? I also don't see "her" being ordered to repay what OP has given her. He has had the option at any time to request DNA testing, he simply chose not to do so.

    Maury Povich is definitely not a good legal source, nor can he fly in the face of the Law.

    Please don't use text speak on the legal boards.

    EDIT: I see that you are in California. I have asked an Attorney in California to look at this post and clarify these points.

    Ok, lets get some facts in here. The ONLY DNA test a court will accept is one that the COURT ordered. So forget about getting your own test.

    If you are not sure the child is yours, then tell your parents to stop giving the girl money. That weakens your case. And they will not be able to get that money back.

    So what you do is wait until she files for child support, or until the child is born. When she files you tell the court that you don't believe the child is yours. The court orders a paternity test, which they may or may not bill you for. If the test is positive, you get ordered to pay support. If its negative you walk away.

    If you think there is a possibility you are the father then start saving now!

    You're taking advice from someone that has absolutely no idea about the law.

    The people to listen to here are JudyKay and Scott, not someone that thinks that Maury Povich is a good alternative.

    You can't play around with this, there is a child involved, it's not your chance at 5 minutes of fame. :(
