My husband and 2 daughters live in an apartment. He has told me he wants a divorce, but we haven't filed anything yet. I have to sign another lease soon, and I would like to take him off the lease. Can I do that even though he still lives here with us?

That's up to your landlord. If you explain the situation he may allow it. Otherwise your husband may have to move out first.

If your old lease is ending, you, or any qualified person, can sign a new lease. Do not assume the new lease will allow 4 people to reside, ask to see that part in the written lease.
