Son aged 39 & new wife will not or can not pay rent needed to stop forclosuer on home owned by mother. I have asked them to move so I can rent out their portion of the duplex so I can save it from the bank taking it over... they will not move, pack or help in any way. How can I evict them so I can rent out their spot as soon as possible? (There is no signed lease, they occasionally give me $200.00 but their combined income is $1,100.00 She does not clean and the place is in need of repairs due to their neglect) The new wife has threatened to take me to court. I have owned this property for 29 yrs and do not want to loose it, What do I do about this??

Saddly, there is no such thing as a quick eviction. It can take upwards of three months sometimes more depending on how busy your county is. You need to contact an attorney and have them served with an eviction notice. This is a 30 day notice. (some states you can serve them in writing with out an attorney but in my state you need to use an attorney) Then if they still refuse to move then you get a court date and go to court to have the judge issue an order for them to leave the property where I come from the judge gives an additional 30 days for them to get out (I have heard of it being sooner than that but haven't personally seen it).
