    Moving with a child, kidnapping?
I have an 11 month old and want to move to another state where the cost of living is so much cheaper-maybe 1000 miles away. I'm not married to the child's father but he is to a woman he hasn't seen in 5 years+. We haven't been to the court yet at all. Can he stop me from moving? Is it considered kidnapping?
He's been verbally abusive to me, has cancelled seeing the baby due to his career and lives in an illegal apartment. He hasn't filed for divorce either. Do any of these things work in my favor?

If he is on the birth certificate he is the legal father and has rights to the child. But, absent a court order for visitation, it would not be kidnapping for you to move, especially if you inform him where you move to. Its possible that he might be able to force you to move back, and its even more possible he can block the move if informed beforehand. But if he has made no attempt to see the child, that's going to make it harder for him.
