TIN - Need Help for H4 Visa
    Hi,

I am new to US. I came here on 1st Oct 2006. My wife and daughter joined me on 16th Oct. And they will be going back to India on 15th Nov for a period of 3 months and will be coming back to US again in the month or Feb 07.

I have following questions in mind -
    1. Can I claim that them as dependent on my tax starting oct 06?
    2. How should I apply for their TIN number?
    3. Can I claim for tax rebate for the period of 15th Nov to Feb 07? When they are not in US? Or it is not allwoed to claim these tax returns?

Please guide me with the process.

    Thanks in advance.

    Ketan:

    1) I will assume you are on a H-1B visa. You will have to file a non-resident return for 2006 since your wife will not be in the U.S. for the last 31 days of the year. You should be able to claim both your wife and child as dependents.

    2) When you file your return, you will fill out a Form W-7 for your daughter and wife to get them their TIN.

    3) Given that you will be able to claim $9,900 for yourself, your wife and your daughter, you will probably get ALL of your withheld taxes back for 2006.

This is a TAX Forum; you are better served posting this question on the LAW Forum under Immigration Law.

That said, go to the U.S. embassy or a local U.S. consulate get such details on how to get a visa.
