I was at walmart the other day and I was shoping with a friend and we used the same shoping cart and I made my purchases for groceries and clothes but I forgot that I put some items in my purse that I was going to purcahse. I know it was dumb to do that but I honestly didn't want to get my items confused with my friends and I walked out and forgot that I had items in my purse and I got arrested.
I'm terrible embarrassed and ashamed and it was an accident and a mistake, I just gradurated the nursing progam and I talked to a lawyer the other day and he said that that because this was my first offense that he can when I can pay him try to get it down to an infarction or an early dismissal.
But my question is can I get my nursing license with this on my record?

Talk with Walmart about dropping the charges (if its not too late). A buddy of mine stole a pair of gloves a few years ago at K-Mart ($9) and was caught. But they gave him a warning, and had an agreement to pay a fine of $300. No police were involved. Although it sounds like they believe your intentions were to steal and probably won't. As far as the License, I'm pretty sure you will be able to get the License - the bigger problem is getting a job with them seeing that on your record.

KMart and Walmart have VERY different policies. In my area, at least, Walmart prosecutes every shoplifting/theft.

You put the items you wanted to purchase in your purse, forgot they were in and walked out of the store? I think you are going to have trouble selling that.

At any rate - I would get the best Attorney you can afford because this arrest can keep you from getting your Nursing License. I'm not even sure that getting it reduced can change anything because the license application requires you to disclose all arrests.

I'm not buying it. I doubt they will either. When you hide items in your purse it's considered stealing. They aren't yours until you pay for them, so you're not allowed to put them in your purse.

I'm aware of the probability that they might have different policies, but it's worth a try. When my buddy stole from K-Mart - the security guy told him that the corporations work together to reduce crime and exchange their blacklist. Perhaps she can admit that she indeed did steal (and may be willing to work a deal out with her)

Sounds more logical, but just in case :p

Unfortunately, depending on where you live, your chances of getting your nursing license are slim.

I'm not buying this story either. It's possible that WalMart has you on camera putting the items in your purse. If that is the case it shows probable cause that you had every intention of stealing these items.

If you DO get your nursing license, there is a slim chance that you will get hired. After you apply for your license you still have to have a background check done at any facility you apply to.

I'm actually an investigator - I don't know where you live or who told your "buddy" that this is store policy but it certainly is not in my area.

I stand by my original advice - best Attorney she can afford and then follow his/her advice.

The OP is in NO position to attempt to negotiate anything directly with Walmart. And as long as she sticks with the "merchandise in my purse by accident" story I don't think she has a chance when it comes to reducing the charges.

Sorry Judy, I have to spread the rep before giving you another greenie. But, and I worked in a place similar to WalMart (Meijer), Loss Protection looks at it this way... If you put it in your purse, you have the intent of stealing. Where I worked many moons ago, this, in and of itself, was considered stealing. You didn't even have to walk out the door with the merchandise.

As you've been told, a conviction for shoplifting will prevent you from obtaining a license...

So, you have to make sure that you AREN'T convicted. You're going to need a very good lawyer to do that. But, I'd drop the honest mistake bit... I don't carry a purse, but what you describe would be the same thing as if I put stuff in my POCKET while I was INSIDE the store. Nobody is going to buy that you didn't know that... You should also know, that every step you take while inside a store is being watched...

If you have a lawyer who can get it down to an infraction, which is the same as a traffic ticket, you MIGHT still get a license...

The reason you probably won't get a nursing license due to the shoplifting charge is evident. If you'll steal from a store, you definitely will steal drugs from a hospital or doctor's office setting. You just can't be trusted as you've proven yourself to be untrustworthy. Who knows how many other times you've "forgotten" the stash of stuff in your purse before and gotten away with it.

You were caught. Now you'll have to face the consequences.
