    Last name issues
    I have a 6 week old son with my girl friend and live together but are not married on our sons birth certificate he has my last name first then hers but every were she takes the baby like doctors and such my son is registered only with her last name is this legal is this her doing or is it in the order the last names are on the birth certificate

    It is legal to use any name one wants as long as there is no intent to defraud. Some things will require a copy of the birth certificate like registering for school. Those places will require knowing the legal name.

    Our sons last name is nazario monto, in school how would he be registered my concern is not having rights in my sons life because he will show up as monto and I'm nazario

    I'm in New Jersey is it law that because our son is nazario monto that he is going to be legally named max monto because of the order the last names are in I would like for our son to carry his fathers last name is this an issue because we are not married I am a proud papa and I would love for my son to have his fathers last name

    Please site such a law. If the birth certificate shows the last name as Smith-Jones, that that is the child's legal name and has to be used werever a legal name is required.

    What name your son uses has NO bearing on your legal rights. As long as you are listed as the legal father you have the same rights no matter what name is used.
