My girlfriend was issued an order of protection in New York city against an old boyfriend who forced her into his car and held her against her will for 5 hours. The order of protection was issued for two months the case was adjourned until the end of October before a referee/court attorney can he continue order of protection or will he refer case to a judge to extend the order she is still afraid of the old boyfriend.

I don't know what's going to happen. MOST times the other party doesn't show up, and the order of protection is ordered by default. If he shows up, he'll be asked about the kidnapping. If the judge believes him, the OP won't be ordered. If he believes your girlfriend, it will.

This order of protection has been in effect now for 8 months he hasn't bothered her during this time but she is still very afraid of him and wants her day in court to tell the judge about all the prior threats and actions he has made against her. She has gone to court four times in the last eight months and the hearing has always been adjourned to the next appearance we felt this was OK as the order of protection continues in effect. Its now two days before her scheduled hearing and her lawyer says she met with his lawyer and wants her to sign a deliberation ? My girlfriend did not ask her lawyer what this is . She just wants to have her say before the judge and get a permanent order of protection . Any help in explaining this would be appreciated...
