I need info on how to evict my ex-boyfriend. I live in Illinois and have spoken to the law enforcement and they tell me that, I will have to given him an eviction notice. He is not on the lease, no utilities, nor receive mail at my address. He recently was released from parole within the last 30 days, from another address (his grandmother's home). So legally I can show that, he has not established "legal" residency (30 days) at my home. Law enforcement knows that he has been staying at my home during this parole time, so they won't enforce the trespassing issue and make him leave. Please give any info on how to successfully accomplish this eviction. Also,he does not support my household in any given way. Thank-you for any info.

Oh boy, you should be able to call the cops and that should be it but if they won't do anything I really don't know. How ever if he isn't a legal resident at your address he should have to leave when you tell him and the police should have to enforce your request if he won't leave on his own. Is his drivers license in your address or any other government id? If so than he is considered a legal resident of your address and that I can't give any info as to where to go from there.

Judy is right, even if he contributes nothing and is not on the lease you may still need to follow all eviction regs as if he were a resident. By the time you could get a court date to prove he has not established residency you could have him evicted.

Yes, I read your reply, I just didn't understand the length of the notice and how one differentiates between the 3. The 5 days includes delinquent rent payment, 10 default on lease, and 30 on month to month. Sorry for not understanding and needing clarification on a subject that, I have no knowledge on. Myself (sublandlord) can serve him with a 5 day notice on the fact he did not pay rent or on what basis. And I do not need to involve my landlord, in order to get this achieved? Thanks for your patience and helping me to understand the procedure and laws involved in this matter.
