    Evicting adult son in California
    Hello,

    My 22 year son, refuses to leave my home. He is mentally and physically abusive and refuses to get a job. When I tell him to leave, he states that he knows California law and that if I give him eviction papers he will refuse to sign them.

    If you give him eviction papers ( i.e. have him served with them ) he doesn't have to worry about signing anything. They are legal and he will be removed if that's his choosing. Also I would request a restraining order if your going to go through with this.

    The only thing about the law where your concerned is the presiding law of your district you live in. Many cities / townships / counties have their own rules as far as how fast you can move on this and there may be a hearing. Best to talk to a realestate lawyer near you.
