I recently was charged with second degree misdemeanor but have not been to court yet. My husband and I are apartment hunting and the landlord want us to submit to a background check so my question to you is will my charges show up on a background check before I have a chance to fight it?

They may show up, depending on the reporting system. However, a charge without a conviciton should not keep you from renting.

I disagree - whether it matters is at the discretion of the landlord. Even a HINT that the tenant may be a problem will probably cause the landlord to look at another prospective tenant. Maybe it should matter, maybe it shouldn't. My feeling is that it will.

Depending on the background check, arrests WILL appear.
