    Is a disclosure required in Alabama when selling a home
    My husband and I purchased a home from the owner last year in Sept. The longer we lived there, the more problems we discovered. I contacted the owner and asked how to go about leaving the residence and was told I had to sell the residence. Since I had to no paperwork to prove I was even buying the home, I didn't know how to do that. Unable to get any answers from the owner, and with problems increasing, we decided to leave. I sent a pro-rated check to the owner via certified letter. I just received a letter from the owner threatening litigation. I am wondering if it's required in Alabama for the owner to disclose all exsisting issues with a residence to the buyer at the time of the sale. There are a lot of other questions I have as well but I will begin with this one. Thank you.

    First it doesn't sound like you purchased the home, but entered into a contract for sale. If you actually purchased the home you wouldn't be sending payments to the WOULD have documentation and you wouldn't be paying the owner anything unless he took back a mortgage, again you would have documentation.

    Without any paperwork, you have no proof of purchasing. On the other hand, the owner has no proof you were purchasing so no grounds for litigation.
