    Can I leave state with my daughter
    Me and my daughters father share joint custody with primary placement with me he gets her two days a week. The rest with me. I want to leave the state of New York to go to Oklahoma what would I have to do do to be able to do this. There is no agreement that I cant.:confused::confused:

    You share JOINT custody?? How would YOU feel if he took your daughter away from you??

    The VISITATION order from the court says that the father gets visitation... THAT pretty much tells you that you can't leave. If you do, the judge will probably ORDER you back.

    In addition to what Excon said, you need the permission of both the court and the father to move or risk losing custody and/or facing jail time for either kidnapping or contempt of court.

    What does the father say about the matter?

    First thing is that you would have to get the father's permission. Then have whatever new arrangement ratified through the court. If he will not give his permission you can attempt to have a court order it, but honestly, I wouldn't bet the farm on a favorable outcome.
