    Statute of limitations in PA. With no charges filed and not being arrested.
    In April of 2009 my house was raided with a probable cause warrant for the sale of marijuana. They has 5 controlled buys one me. Upon their search I was cooperative told them where they could find what little amount of marijuana and cash I had. They got less than $2000, 2 dirty pipes and my personal head stash of pot (about 9 grams). They also took over 300+ clean glass pipes (purchased with legal money that I gained from an inheritance) that I was going to open a head shop with, they were all stickered "for tobacco use only" and were in a locked addition to my home no where near where anything else was found. While they were here they kept telling me you are not being charged you are not under arrest. They froze my bank accounts until I had them check the deposit of the inheritance check I received a year prior. Its been almost 5months and I haven't heard anything from them at all. How long do they have to file charges since I was neither arrested or charged when they raided my home and what they found did not support their warrant (which labeled me a "high profile marijuana trafficker")?

    5 years assuming it will be a felony charge. 2 years otherwise.

    If in the US, the state will make a difference, but the 3 to 7 years would be a norm for a felony

    Hello pot dealer:

    In addition to the answers you got, I'd hire me a criminal attorney to see if I couldn't get back my pipes. The cops didn't need to take them. Cops suck.

    They took them under the rational that I bought everything with "intermingled" drug money, but when they seized my bank accounts found no deposits of money except for my unemployment and the inheritance. They also are trying to consider it "assorted drug paraphernalia" because I was selling marijuana. So I'm worried they'd try and charge me for each piece. Can they do that even though it was all clean and labeled "for tobacco use only" since they took 2 pieces that contained residue?

    I'd be worried that they'll be reeeeeal a$$holes too... But, of course, KNOWING that they ARE a$$holes, stops me from worrying about it too much. It should stop you too. You should hire yourself the meanest baddest criminal lawyer you can find, so maybe the prosecutor might get a bit worried about you.

    If you do NOTHING, they'll KEEP your stuff, and convict your a$$. Don't let 'em RIP YOU OFF like that, and don't let them convict you for what, 9 GRAMS of pot??

    The COPS are the criminals here - NOT YOU. To DO, what they're doing to you for NINE LOUSY GRAMS of pot, IS A CRIME!!

    I had spoken to a lawyer about the return of my glass but he was trying to say that it would cost more to get back than its worth, even though the retail value of everything they took pipes, water pipes,stash cans, grinders, pollen presses, pouches and digi scales is well over $40,000. But you're right they are the criminals here.

    Hello again, marijahoochie smoker:

    The ONLY cost is his time. Plus, it should be something that your criminal attorney would automatically DO in the natural course of representing you. If your criminal attorney say's he won't do it, or wants to charge you more, FIRE him and hire another... IF you haven't hired a CRIMINAL attorney, I'd be getting to that.

    But, this time, instead of inquiring about your glass, I'd inquire about your a$$. It doesn't hurt to shop around, either.
