Breaking a Lease in California
I signed a lease agreement to rent a room in a residential home that began September 2006 and was to end in June 2007. Due to changes in school plans I decided to terminate my lease after staying there for only 2 weeks. I moved in at the end of September and into the beginning of October. I paid for September and October as well as a deposit. My landlord is demanding that she keeps my deposit as well as have me pay half of what I would've paid in rent for the remainder of the lease. I understand that even if she doesn't put on the contract what the terms of cancelling a lease are that she could charge me the way she sees fit. I was the one who signed the contract but my mom was a co-applicant. But she didn't sign the contract. If I don't have the $1800 can she bill my mom? Also, I think she's planning on replacing me once I move out of the room. Is that legal for her to rent out the room even if I'm still paying her half of each month?
The only thing regarding time that is mentioned in the contract is this:
The Tenant(s) shall stay upon a tenancy commencing on09/01/2006 and terminating at 12:00 midnight on 06/30/200, at the monthly rate of $450 payable in advance on the first day of each month with a deposit of $450 in the initial month. Should the term commence on a day other than the first of the month, Tenant(s) shall pay the amount $ _______ (this was left blank) for only the initial month starting on _ _ / _ _/ _ _ _ _ (again left blank). These premises shall be occupied for residential purposes and for no other, by the following named persons and no others: (my name)
