Well, it depends. Does she want you to have full custody? If she and the legal father are opposed, there is nothing you can do.

Forget custody. Ask then if they will allow you to have guardianship of the child. While custody and guardianship are similar, guardianship is more of a temporary thing. Tell them you think your nephew can benefit more by being in your home environment. At least until she and the father can provide a more stable home.
