My father is 77 he wants to seek custody of his 1 year old son. His girlfriend was supposed to go to rehab for a crack addiction and return back after. She prommised to keep contact between him and the baby while she was in rehab but never did. She has three other minor children that all live with there fathers. She has a history with children services. And owes back child support. The family feels that she only wants this child because my father is over retirement age and she receives a social security check for him. She actually made the comment to mutual friends that he was her little meal ticket. My father will have great family support what are his chances of getting custody and will his age be a factor?

What State? I can't imagine that his age WON'T be a factor BUT can he prove that the mother is unfit and a danger to the child? That's step one.
