    Dads Ashes
    Good Afternoon,

    I live in ny, My dad passed away just last week and I was never acknowledged that I was his daughter, his girlfriend of 16 yrs was his beneficiary as well as the one who made his arrangements. There was an autopsy done after his death, I guess my question is who has the rights to his autopsy results as well as his ashes? :confused:

    In the hospital all was directed to her as his wife, she never once turned around and said this is his daughter.

    Legally? In was in my life everyday we had a great relationship, I do have his last name if that is what you are asking.:o

    Was he ever declared to be your father by the Courts, possibly using DNA?

    No matter what the situation, his wife (now widow) is his next of kin. You have no standing concerning his ashes. In NY you are not entitled to the autopsy results unless you suspect foul play and get a Court Order to release that info to the DA.

    - and trust me on this one. I've been there.

    That is what I am currently working on now, I am just waiting for the funeral home 2 release his death certificate so I can carry that to the court house and file a petition.

    What are you answering? What are you working on?

    Are you his legal daughter?

    In NY I am not aware that other than the spouse can obtain the Death Certificate IF that is the wish of the spouse. I know - as I said, I've been there.

    What is it you are looking for, trying to obtain?

    In the first post I noticed you said girlfriend of 16 years. But then you said everything was directed to her as his wife. So which is she? Girlfriend or wife?

    Yes I am his legal daughter, I am working on getting rights to his ashes I just have to wait till the death certificate comes in to the funeral home. She is his girlfriend of 16 yrs, they were never married.
