Hi guys an elderly friend of my mother is in the hospital suffering from dementia. She has in place a durable power of attorney as well as a health care poa however the gentleman she designated her poa too does not wish to help her. Does he now have sole power or is there anyone else that can help. Oh yeah she lives in South Carolina. Thanks in advance AC

He holds the POA as of right now but that doesn't mean it can't be transferred to another person. Why are they trying to duck out on the POA ?

Thanks for the response does the current poa holder have to tranfer POa or what my mothers friend has been declared incompetent by her doctors.how can poa be transferred? I'm not sure why he doesn't want to do it. All he will say is not interested and has stopped returning calls so I'm just not sure.

Yes they would have to transfer it away if they no longer want the responsibility. Otherwise they leave themselves open for a lawsuit if they don't act correctly.

So for the sake of the person its in their best interest to release it to someone who is willing and able to take care of business.
