Carpet charged didn't receive
In February I purchased some carpet at a small company, we agree on the carpet and an install date. At that time I paid over the phone with my debit card, on the day that the carpet was to be installed, I called that morning and was told that it was still in Georgia, ETA four to five days later. At time of purchase I was told 7-10 days for delivery... well this was on the 11th day that I called. I never was given a contract to sign, and didn't even sign the credit card slip. Therefore I called the company and cancelled the order, was told I could not do that. I had no carpet, no installation of the carpet or padding, taxes etc... Well Bank gave credit to my account, thought everything was fine, paid for new carpet had it installed next day everything seemed fine. Three months later my bank was closed by FDIC, day before they closed they charged back my account and sided with carpet company. I now owe FDIC $1300.00, still never rec'd carpet or install, was told I have to take this to small claims?? ugh! Carpet place did call 60 days ago to try and sell my carpet to someone else for $450.00!! Still want to keep the additional $850 for doing nothing... Please Help. What do I say to the judge, and can I get my filing fees back??
