Is it possible for me to get 1 mph knocked off my speeding ticket?
I was pulled over for going 15 over yesterday and also got a ticket for an expired insurance card (I am insured so I can get out of that). I have to go to court in Oct. for these. Is there any way I can get 1 mph off? That'll be 4 points for 15 over, giving me 6, meaning in NJ I will need to pay $150 a year regardless of whether I take any class. If I can get 1 mph off, I'll get 3 points instead of 4. I'm a student in college and I don't have the extra money.

We can't say what will happen in court. If you were speeding, then that's what it will be regardless of you being a student or not. What do you mean 'you are insured so can get out of that'? Why did you have an expired insurance card on you? Don't you have to prove at your court date that you did in fact had insurance at that time ?

Yes I have to just have proof that I was in fact insured at the time. I wasn't aware my card was expired because it seemed like just yesterday I had it renewed.

    Hello jp:

Yeah... The last ticket I got, I paid for with the EXTRA money I had laying around... Dude! I think you mistake the people who are involved in your prosecution, with people who care.

I live in nj too and in the driver manual it says that 3 points are taken off every year if you don't have another violation. Is the $150 for the ticket or the points?

If you get 6 points you have to pay $150 for three years

If your driving record is relatively clean, there is a way that usually works to reduce points. What was your last violation and about how long ago was it?

I hope the mandatory court appearance is due to the insurance card and not the miles over.

What court are you going to "Justice of the peace court" or "Court of common pleas"?

My wife did the same... don't know how she worked it out... I'm not a legal guy. She mightve talked to the attorneys office... basically got a mile or two knocked down for some extra dead presidents.

Often you can get with the DA before the case and ask to plead guilty to the lower amount. But it may well be worth the cost of an attorney on this.

Also please note, they can still convict you of the insurance card if they charged you with merely "no proof of insurance" that means you did not have a card with you. It is a different crime than "no insurance"
But normally they don't, but can.

This is just a for instance, but in Ontario it is $120 fine for driving without proof of insurance and there is no respit, you can't just go to the local precinct and give proof as before. You get a fine for 120 on the spot.

You guys are telling me it is so easy to get off a charge like this down there. Just don't drive in Ontario without proper ID.

The last time I got pulled over was in May I believe.. I got pulled over for speeding (I know, I'm getting the hint to slow down), but got a ticket for expired registration. Before that was last year, summer, pulled over for one reason, ticketed for no headlights with windshield wipers on. And last April I got a ticket for 9 over.

Under those conditions, my trick probably will not work.

You can try asking for 1 mile less or you can try asking for "Probation before judgement". Which could mean, the offense is in limbo until a certain time passes. Hypothetically say 3 years.
Your probation could be "No moving violations in a 3 year period" and the charges get dropped. If you do, you pay the fines and consequences. You then have a reason to slow down.

I'm not sure it's applicable, but it might be.

Cops are getting smarter and the technology is getting smarter on both ends. GPS systems can warn of radartraps. I think speedtrap.com lists common speedtraps.

The cops have Laser and they like playing the 2 car game. There is a cop with radar and then one, a mile down the road.

There are revenue producing areas and there are safety ones, There have been stories where mothers complain about the speed in a school zone and when the cops do their thing, they catch the mothers.

Hi KISS, if this guy is speeding he needs to slow down and mature. There is a lot of responsibiity to having a drivers license. He needs to be in a no tolerance area where this is not allowed. What benefit does it serve to tell him how he can get out of a speeding ticklet, in this case several, and in one instance, no insurance proof.

He couldn't drive in Ontario. We have zero tolerance on our roads which is a good thing. I am so glad he didn't say he was speeding because he had been drinking. Or maybe we have yet to hear this.

expired registration is not no insurance proof. Probation before judgement, if allowed, might actually hit him harder. He's got to make the right choice.

One break, might help. He did have the forthough to check what could happen after the fact.

One break, where the consequences of violating are EVEN GREATER than what mess he is in now, I think, has the popensity to turn this guy around.

Have I driven at 120 MPH, yep. I had a Pinto up to 95 MPH when I was about 17-18 YO. My father drove at 120 with me in the car.

The suggestion is not the one I normally use.

You sound like the typical "cop magnet". Some people are magnets. In the future you will definitely have to stay legal. Don't speed. Keep your valid insurance card, valid registration, and valid driver's license in the car. And keep your vehicle in good repair.

And no, they are not going to deduct the 1 mile per hour from your ticket. Why should they? You were speeding and got caught. Why should you get preferential treatment? Are you someone special just because you are a student? No. Get ready to shell out the money and learn your lesson (the hard way).

P.S. Once a cop magnet, always a cop magnet.

Firstly, I'm a female. I'm not saying I'm not in the wrong for speeding. I'm saying I work my butt off between school and work at 19 years old and I think 1 mph and $400 saved seems a heck of a lot better than the other way around.

You never answered the question what kind of court. Justice of the Peace or Court of Common Pleas.
