Ok we moved out of our home around 8 month ago, we are going with bankruptcy but we have not completed that yet. Our old home is still empty and I checked it is still in my name would the bank consider letting us have it back? Our situation has gotten better my husband has gotten a raise my income is better. What our the chances? My children miss there old friends and want to go back home.:confused:

No it has not foreclosed yet!

Have you been making the payments or defaulting?

No I have not made a payment, But wondering if they would make a compromise I would think it would save them time and money too??

Contact your lender about a Loan Modification or repayment plan. There are plenty of available options like President Obama's Making Home Affordable program. Be prepared when you call and have all of your financial information and debt information ready. 8 months later your home is in active foreclosure, there is no way it isn't, there just isn't a sale date yet so there is still time. If you are in the position where you can afford a new possibly lower payment chances are good that the bank will work with you, they stand to lose money if they sell the house at auction. There are HUD approved agencies that can assist you with this as well as some "not so accredited" companies. I used someone I found on yellow pages and the outcome was incredible! I was in an interest only loan paying $2400 a month! My new payment under president Obama's program is $1139!! AND I am paying principal and interest! That's after 6 months of missing my mortgage payments. SO give them a call and see what they can do!
