    Please help me out!

    My father recently passed away.
    He has children but not with his recent spouse.

    He is the owner of real estate / house
    He is married since 3 years, but the property is on his name only.

    What will happen to the estate?

    Are his children entitled to this property, and what about the spouse?

    Was there a will? Is there an estate executor?

    I'll add one thing to the advice Ballinger already gave you - what State?

    The length of the marriage does not matter. The spouse is entitled to collect SOMETHING if there is no Will but that percentage varies by State. Whether he has children with his current spouse also does not matter.

    If there IS a Will, of course, it would prevail.

    Can't give Judy a greenie quite yet but she is on the money here. I think in Illinois the kids and spouse would all get equal shares.
