    Lien on son's ss check
    Hi. I have a checking account that was opened and is used solely for the purpose of my 14 year old's social security checks. His dad passed away and he gets a monthly check now. He can't open an account because he is a minor. Can someone put a lien against this account? What should I do, and who can I get in touch with about this? My son's school tuition comes out of this account. Please help.

    If this is going into a chequing account opened in your name for the cheque to be automatically deposited, then cancel the automatic deposit and have it sent to your home address, then you and he can cash them. I know the money can't be deposited to pay tuition by cheque, but you can use cash to issue a money order, either bank money order or postal money order, for tuition.

    If either you or he has been sued and lost, then the account can be seized. IF the funds going in are strictly SS, then they are exempt from levy. Show the bank that the ONLY money going in there is from SS. They SHOULD release the lien. If they don't, speak to the LEGAL representative of the bank.

    I'm confused - are you asking if someone CAN lien against the account or are you saying someone DID lien against the account?

    Is it in joint names or are you the custodian for your son - it makes a difference.

    You appear to be concerned about a lien - what is the lien for?
