I was under the impression they can not give you a vop for a crime that was committed before the crime that put you on probation. Am I correct.

Here the short story.. Something happened on new years eve that now I'm getting charged with yesterday.. Committed a crime in feb that put me on probation in april/may..

But my po is trying to give me a vop..

There's what they're SUPPOSED to do... and there's what they DO. They're not the same. It's true, you can't be charged with a vop if you actually didn't... That doesn't mean they won't try. If you can't convince her on your own, then you're going to need a lawyer.

Im sorry I guess I didn't understand your post back. My mind is kind of worried right now.. Are you saying I can't be charged with a vop if the new charge is for a crime that happened on new years which was before the crime that put on probation.. If u could go a ll in depth for me to ease my mind ti would be great.

Just sucks I spoke to her this morning and she was like vop for u. I told her this new charge is from something that happened before I got on probation.. She also wants police apidavits which I thought I can't get till my first court date.. The odd thing to about that its like 13 weeks away..

I appreciate your timely responses and your knowledge. It does help ease my mind as I am a nervous wreck.. An to my yesterdays post now they are only doing simple assault vs agravted assault

Relax... The fact is you cannot be charged with violating your probation when you weren't on probation when the offense occurred. It shouldn't be a problem because you have all the dates on all the court documents. If SHE wants the affidavits from your police file, I think she can get them. It oughtn't be YOUR responsibility to get them...

In any case, I'd wait until she actually VIOLATES you instead of talks about it.

Thank you.. YA she wants the papers from the new charges.. She said I need to bring them to her. I told her I I can't get them till my court date. She said its my right to have them. I told her not till I go to court and the states da has them. Then I am entitled to them..

YA I was just worried a little bit cause I havea daughter and all.. The new charge I'm not worrieed about cause ima going to ifhgt it and hopefully win it.. She was unclear of the rules anyway so maybe shell figure out that she cant. My court date is 13 weeks away. I thought standard protacal was 6 weeks..
