Your husband is the legal father. As such he has rights concerning his child. You cannot change the birth certificate without his agreement or a court order. And the courts are not likely to grant it without his agreement.

It is not compulsory to give your husband's name, but it is compulsory to submit a birth certificate. You can explain to the school that you are involved in a divorce and you would prefer the child uses your maiden name whenever a legal name is not required.

The courts would never allow it at this time. You can't change names while your in court and going through divorce and custody issues with your ex. And if you don't put him on as a contact then it only shows your not willing to participate as a parent. That can go against you rather quickly.
