Ask Me Help Desk - Paid off Owner Financed Mobile Haven't gotten paperwork

We purchased a owner financed mobile home April 08. In our mortgage agreement, we had 3 years to pay off the financed amount. It was a sum of 4,000 dollars to be paid within that 3 year time frame with no interest but if we did not pay within that time, another thousand dollars would be added for each year we didn't pay. Well, we paid it off on June 4th of 2009 by check, check has been cashed and we have not received any payoff mortgage release paperwork at all. How long does an owner have in NH to give us paperwork showing the mortgage has been satisfied? Our problem is that we need a third party removed from the deed and can't do it until they see that the mortgage has been paid off. What can we do to motivate this seller to give us the paperwork we need? We have emailed, called, etc. I can't find any NH law to quote that he has a certain amount of time to provide us with that information. Any help will be appreciated. Thanks :(

First of all did you actually see any title showing that the seller actually was the listed owner of the mobile home or did you just take their word for it? Also, if the home was not owned outright and the seller had a loan out on the home, then they would have the title showing that they have a lien on the home and that must be satisfied before the owner can legally transfer the title to you.

You could go to the DMV and ask them exactly who is the owner on the title of your home. Get the serial number off the metal ID plate affixed to the outside lower corner of your home and take that number with you. That will help the DMV folks to get the right home title info for you.

You need to send a certified return receipt letter (and send them the same letter regular mail also) demanding the title be properly prepared for transfer into your name by the seller.

If the seller does not comply with your letter you then take whatever paperwork you do have and file a lawsuit in small claims court for the title to be transferred to you.

The title for a mobile home is treated the same as a vehicle.

You had a loan, not a mortgage on this home. A mortgage is for real property, a loan is for a vehicle or mobile home.

I have to correct you, In New Hampshire Mobile homes are considered Mobile Homes not Vehicles as you would see in Florida. They are deeded at the County you live in. We also have a closing in NH with Layer and seller and purchasors present. To clarify, I want to know how long a seller has to produce the final paperwork to be filed with the State of NH when a owner financed home has been paid in full. Thanks for your input!

Mobile homes are considered under the DMV and are considered vehicles in all states as they are indeed "mobile" and capable of being hauled on the highways.. I worked for a new manufactured home dealer and handled all the title work so I am quite familiar with mobile homes and titles. You can still have a lawyer present at a closing. The county issues you a title for the home through the state like you would get from a vehicle, not a deed.

If you had purchased a mobile home brand new the dealer would have had 30 days after all monies paid to produce your title.

The time has come and gone for your seller to produce the paperwork.

You can still go to the county and see just who owns the mobile home according to the county. Someone would have to be paying the yearly tax on the trailer. I can't imagine NH to be any different than all the other states in handling mobile home titles UNLESS the land was included with the home and the home had been converted into real estate by the county once the original title or MSO or MCO (manufactured certificate of origin) was surrendered to the county for conversion into the deed of the actual land.

NO, You are Incorrect and this is not the way it is in NH. I have a warranty deed that is recorded with the State of New Hampshire. I lived in Florida and yes they treated our mobile down there as a "vehicle". We had a title and went to the DVM to transfer it, etc. In NH we do not do that. Please check NH.mobile homes as real estate. We don't transfer Titles, we transfer real estate deeds on them and they are recorded as property. We are located in a Mobile Home Park. This is not helping me get my legal answer. We are not issued a Title. We are issued a DEED from the STATE of NH transferring the Mobile Home from Owner or Owner and is recorded in the State registry as a deed - as if it were a HOUSE.:cool:
The Seller did own the mobile and was paying the town taxes and we have been paying them since our purchase. Thanks for trying to help.

Yes, I ended up googling NH mobile home titles, transfers, etc. and you are correct. Well, if that is the case then if the sellers did own the home then they need to get their act in gear and transfer the deed over to you. Send them the Certified Return Receipt letter demanding that they do this and have 10 days from the date of your letter to do the transfer or you will be forced to take them to court. Then send them the same letter regular mail in case they don't bother picking up or signing for the certified letter. Then take them to Court. You have no other recourse as they should have transferred the deed over to you within 30 days of the final payment.

You could go to an attorney and have the attorney send them the letter demanding the deed. Kind of makes it more official to have an attorney involved and makes the other person wake up and smell the imminent lawsuit.
