I live in the state of MI. Does anyone know the laws for DWI concerning the second violation of probation. The violation was not refraining from alcohol. What can I expect from a second violation? This was a failed ETG test.

Here goes My fiancé violated his probation for the first time on he is in jail and the judge told him he had to stay there for 60 days to 12 months but only be in jail for 60 days will he be out the 60 days and the remaining months be added onto the probation for 10 months .He only violated a first offense violation but was not arrested he is waiting for a reevalaution.

I'm confused - I've never heard a sentence where an "either/or" is involved.
He will have to serve between 60 days and 12 months? That's a big spread.
Can you explain a little better?
