You don't.

He didn't leave his kids unsupervised or in a dangerous environment, therefore, he's not guilty of abandonment.

What you DO do is go to court to get child support from him.

What do you expect to happen from trying to file abandonment charges? What you need to do is what synnen said and file for support. If you already have an order for support and he is not paying then go back to court to have that order enforced. You can't just file abandonment charges if he left the children with their mother and the mother didn't want to get court ordered support from him.

Have you ever been to court for child support and visitation for the child ?

Does he pay? Does he call? Send presents?

Is there someone in line to adopt the children?

In some cases you can file abandonment (my sister recently did this), but the child was being adopted by my siser's husband.
