Hi everyone. My husband has a daughter with a another woman from a previous relationship. The mother of the little girl was involved in domestic violence and the court gave temporary custody to the my mother-in-law. My husband and I currently live out of state and he only gets to see her about once or twice a year.

My mother-in-law wants to have custody of the little girl but my husband wants to bring her to live with us. The mother of the little girl is going to sign an affidavit giving my husband sole custody and that he can take her out of the state. What are the chances of my husband obtaining sole custody? What documents should we take to court? Lastly, what will we need to do afterwards so I as her step-mother can act as her guardian? Thanks so much in advance. :)

He should have more rights than the grandmother, especially with the mother giving her approval. He needs to go to court and file for sole support and then it can get formalized and legalized that he is to have the custody. You really don't have to do anything.
