Being that the father was not around when the child was born I'm going to guess that he didn't sign the birth certificate. So, when you petition the court for a support order the judge will first have to order a paternity test (yes, it does have to be court ordered to hold up in court). When the results come back to show that the man you say is the father is the father then the judge will give you an order for support. The father can then also ask for a visitation order. It isn't like the father will automatically get overnights since the kid doesn't know him. However, the father will be able to get some visitation and it will gradually increase.
