What does exclusive possessory rights mean
    Hi all,

My Dad's will stated that one of his houses was to be left to my 2 sisters and me. He allowed my brother's exwife and 1 minor child to live there rent free, and left provisions in his will for the minor child to have exclusive possessory right to occupy and reside in him until she reaches age 18. My question is, can we at least charge them rent. They do have to pay taxes and insurance. Thanks for your help

Has the will been admitted to probate? It doesn't really mean much until it has.

To answer the question: from what you say it doesn't appear that you can charge the minor child rent until she reaches the age of eighteen. "Exclusive possessory rights" means that she gets to occupy it and nobody else does (until she is of age).

    Yes, what?

But I agree with AK. She has the right to live in the house rent free until she reaches 18.
